NYSDOL Direct Deposit Rule Blocked

    The NYIAB held the DOL exceeded its authority in issuing the new direct deposit/pay card regulations which were to become effective in March.  Attached is a copy of the decision. 

    NYLL 192 still requires voluntary consent for direct deposit, except for bona fide exempt employees earning more than $900 per week.  NYDOL opinions on permissibility of pay cards likely remain effective, essentially also requiring informed consent and no costs/fees.
